Use of car parks involves significant risk including damage to property, physical harm, personal injury and/or death to users. Any such loss or injury may be caused by, but is not limited to:

• Third party drivers or pedestrians
• Weather conditions and natural events
• The physical condition of the car park
• Criminal activities including theft and vandalism
• Equipment malfunction or failure
• Vehicle collisions or accidents
• Slip, trip, and fall hazards

2. Entry and Contract Formation

Car Park Terms of Entry (Terms):

"The Grove Homemaker Centre Pty Ltd" (and references to "we," "us," or "our" and similar expressions) means The Grove Homemaker Centre Pty Ltd, its employees, agents, contractors, and representatives;

"you" or "your" means any person entering this car park, whether as a driver, passenger, pedestrian, or otherwise;

"Car Park" means this parking facility, including all levels, ramps, walkways, elevators, stairwells, and associated areas;

"Vehicle" means any motor vehicle, motorcycle, bicycle, or other form of transport brought into the Car Park;

"ACL" means the Australian Consumer Law as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

“PPSA” means the Personal Property Securities Act 2009 (Cth).

ACCEPTANCE OF TERMS

(a) By entering this Car Park, you accept that a legally binding contract is formed between The Grove Homemaker Centre Pty Ltd and you on the basis of these Terms.

3. You must comply with:

  1. (a)  all signage and notices displayed within the Car Park;

  2. (b)  all directional markings and traffic flow indicators;

  3. (c)  any reasonable direction given by our staff;

  4. (d)  all height bars;

  5. (e)  all applicable road rules and traffic laws; and

  6. (f)  all emergency procedures and evacuation directions.

PARKING RULES AND REGULATIONS

  1. You must:

    1. (a)  park only in marked bays;

    2. (b)  park entirely within the lines of a single bay;

    3. (c)  follow all directional signs and arrows;

    4. (d)  observe posted speed limits; and

    5. (e)  use vehicle lights when driving in the Car Park.

  2. You must not:

    1. (a)  park in areas marked "Reserved" unless authorised;

    2. (b)  park in disabled spaces without displaying a valid permit;

    3. (c)  block exits, entrances, roundabouts, crossings, emergency vehicle car parking slots or other vehicles;

    4. (d)  conduct repairs or maintenance on vehicles;

    5. (e)  sleep or reside in vehicles;

    6. (f)  distribute advertising material or conduct business activities; and

    7. (g)  smoke, consume alcohol, or use illicit substances.

    8. (h)  park your vehicle in excess of one (1) day

LIABILITY AND INDEMNITY

  1. Consumer Law and Liability Limitations

    1. (a)  Nothing in these Terms restricts or modifies your rights under the ACL.

    2. (b)  For services not ordinarily acquired for personal, domestic, or household use, our liability is limited to:

      1. (i)  Re-supplying the services; or

      2. (ii)  Paying the cost of having the services supplied again

  2. Exclusions of Liability

(a) Subject to the ACL, we are not liable for: 3444-7585-2850, v. 1

  1. (i)  theft of or from vehicles;

  2. (ii)  damage to vehicles;

  3. (iii)  personal injury or death;

  4. (iv)  consequential or economic loss;

  5. (v)  loss of profits or opportunity; and

  6. (vi)  any indirect or special damage.

(b) Security

  1. (i)  We do not guarantee the security of vehicles or property; and

  2. (ii)  You park at your own risk.

8. Indemnification

(a) You must indemnify us against all losses, costs, and expenses arising from:

  1. (i)  your breach of these Terms

  2. (ii)  damage caused by your Vehicle

  3. (iii)  claims by third parties relating to your Vehicle

  4. (iv)  your use of the Car Park

VEHICLE AND PROPERTY

  1. Vehicle Access and Movement

    1. (a)  We reserve the right to:

      1. (i)  move vehicles in emergencies;

      2. (ii)  refuse entry to any vehicle;

      3. (iii)  remove abandoned vehicles; and

      4. (iv)  charge reasonable costs for vehicle movement.

    2. (b)  Vehicle Requirements:

      1. (i)  must be registered and roadworthy;

      2. (ii)  must not leak fluids or create hazards; and

      3. (iii)  must not exceed height or weight limits.

  2. Property and Belongings

    1. (a)  Personal Property:

      1. (i)  we do not accept custody of any property;

      2. (ii)  items are left at your own risk; and

      3. (iii)  lost property will be handled according to law.

    2. (b)  Damage to Car Park:
      You must pay for any damage you cause;

      1. (i)  this includes oil leaks and tire marks; and

      2. (ii)  includes damage to equipment and infrastructure.

Disclaimer

SECURITY INTERESTS AND ENFORCEMENT

  1. Security Interest

    1. (a)  You grant us a security interest (as defined in the PPSA) in your Vehicle to secure payment of all fees and charges.

    2. (b)  If amounts remain unpaid for 30 days:

      1. (i)  we may sell your Vehicle;

      2. (ii)  proceeds will be applied to your debt; and

      3. (iii)  surplus will be handled according to law.

  2. Enforcement and Recovery

(a) We may take any lawful action to:

  1. (i)  recover unpaid fees;

  2. (ii)  enforce these Terms; and

  3. (iii)  protect our interests and property.

MISCELLANEOUS

13. Changes to Terms

(a) We may change these Terms at any time by:

  1. (i)  posting updated Terms at entry points;

  2. (ii)  providing notice on our website; and

  3. (iii)  your continued use indicates acceptance.

14. Severability

(a) If any provision is invalid or unenforceable:

  1. (i)  The provision will be severed;

  2. (ii)  Remaining provisions continue in effect; and

  3. (iii)  The invalid provision will be replaced.

15. Governing Law

These Terms are governed by the laws of New South Wales.

By entering this Car Park, you acknowledge that you have read, understood, and agree to be bound by these Terms.
